The Basic Documents

Durable Power of Attorney allows you to appoint one or more individuals of YOUR choice to make decisions and carry out specified activities on your behalf.

Advance Healthcare Directive allows you to express your wishes regarding healthcare. It is the document by which you choose what life-prolonging procedures are to be withheld or withdrawn. This document includes the appointment of someone you choose to make sure your wishes are honored by the healthcare provider. This is commonly referred to as a Power of Attorney for Healthcare.

Revocable Living Trust does a number of things. You can avoid the probate of assets that are transferred to the trust. You can retain full decision-making authority as long as you choose, or until you become incapacitated. You select who you want to manage your trust assets and affairs. This document is very beneficial when you want to leave assets to a child or grandchild who is a minor, or suffers from a legal disability. The trust document is customized to fulfill your particular needs. Privacy is also protected.

Will governs distribution of assets owned by you at your death. If you use the Will as the document to transfer assets, you do not avoid probate. A Will is often used in conjunction with other estate planning documents.
